The Environment Bill is back in the House of Commons and I am very happy that it is making progress. It is important that it does, but it is clearly important that the positive things in the Bill are communicated. Listening to the media and reading social media would have you believe that I and other MPs are deliberately trying to damage our environment and are encouraging sewage to be pumped into our rivers and seas.
The original Lord’s amendment called for a complete ban through the elimination on the use of storm overflows in sewage systems, which in theory we all agree with but in practice our sewage systems work by allowing discharges in extreme rainfall to prevent flooding. This amendment came with no plan as to how this can be delivered and no impact assessment whatsoever.
It was not something that could practically have been delivered. No responsible government could have supported this part of the Amendment, even if the outcome would be desirable.
We already had a plan in place and today’s Government amendment gives those plans a legal framework.

There is clearly more to do, and I am working with the government on banning plastics in wet wipes, restricting the use of polystyrene packaging, stopping single use plastic plates and more.

Dear Colleague
I am writing to set out my view of the Government Amendment in Lieu of the Duke of Wellington’s amendment to the Environment Bill, which we shall be asked to consider on Monday.
As the Duke’s original amendment was taken from my Private Members Bill, I wished to support it when it came to the Commons last month. I therefore voted against the Government for the first time on a matter of substance since I was elected in 2005, as did 21 other colleagues and several abstained.
There then followed a wholly exaggerated and misleading social media campaign against colleagues who either supported the Government or who had abstained, claiming this meant MPs had voted to allow water companies to continue discharging sewage into our rivers. I publicly deplored this interpretation of the vote.
Last week I engaged with Secretary of State George Eustice and Environment Minister Rebecca Pow to consider the text of the Government Amendment in Lieu, which had been referenced by Lord Goldsmith, seeking to ensure there was a legal duty on water companies to progressively reduce the adverse impact of sewage discharges. This is what the amendment provides for, requiring water companies to reduce the impact of sewage discharges on the environment and public health (the latter being new and important for example for wild swimmers or canoeists).
The reason this will work, contrary to the claims of campaigners, is that it dovetails with the existing provisions in the Environment Bill for each water company to produce a statutory Drainage and Sewerage Management Plan every five years, which will set out how such reduction in sewage discharges will be achieved and funded. There is also a power of direction for government to direct water companies in relation to actions in those plans if they are not good enough.
Campaigner claims that the amendment weakens existing legislation are wrong. The water companies have an existing Section 94(1)(b) duty to treat sewage “effectually”, which has existed since 1991, and the new amendment does not replace nor override this duty.
The problem has been that EA/OFWAT have failed to use their existing section 18 powers (which remain and which provide the enforcement mechanism for this new duty) to enforce that duty over the last 30 years.
The onus is now on DEFRA to give improved strategic guidance to Ofwat (due in January 2022) to require increased capital expenditure on water treatment in the next 5 year Pricing Period (2025-2029).
We cannot fix 60 years of under-investment overnight with a blanket ban on sewage discharges - however much campaigners and we might wish.
It might be helpful to offer one example of the scale and timeframe which can be involved in the largest sewage infrastructure schemes:
Thames Water got planning consent for the Tideway Tunnel in 2014, construction commenced in 2016, completion into service is due in 2025. This is costing some £4.6bn, will be paid for by adding £19 per annum to each household bill in London. It will remove 37million tons of sewage out of the 39million tons legally dumped into the Thames by Thames Water.
I shall be supporting the Government amendment tomorrow, and have discussed it with the Duke of Wellington, who has indicated to me that he does not intend to press his amendment again in the Lords, if the Minister confirms in her remarks tomorrow a couple of points of clarification which he has requested, and the Government amendment passes tomorrow.
I have also discussed the situation with campaign groups who have been backing me, who understand this position. I have remonstrated with them that retweeting misleading claims is counter-productive.
